Gurus,
I have my I-140 approved and have a 2 year EAD. I work as a project manager for a financial firm. I am in EB3 India quota. I currently work on H1B.
In case of a job loss what are my options? By that I mean what kind of jobs should I look for on AC21. Also, can you switch multiple employers on AC21.
Pl advise.
Can I have a hiatus between losing job and getting a new one on AC21 or I need to have an offer in hand before using AC21.
Only serious feedback please.

The U.S. Department of Labor Employment and Training Administration Office of Foreign Labor Certification, issued a Frequently Asked Questions on Permanent Labor Certifications, titled Round 12.
In that update they answer the employer point of contact questions that is often asked by employers. The answer is that the employer must designate as its point of contact an employee of the employer who is authorized to act on its behalf in labor certification matters pertaining to the specific job opportunity for which certification is sought.
The designated employee may not be the sponsored foreign worker. The employer point of contact will be contacted by the National Processing Center to verify whether the employer is authorizing the filing of the application and sponsoring the foreign worker named therein.
Therefore, an authorized employee�s name and contact information must be listed in Section D of the employer�s submitted ETA Form 9089. It is not acceptable, for example, to reenter the employer�s name listed in Section C of the ETA Form 9089 or provide a generic title such as �HR Manager.�
Moreover, as indicated on the ETA Form 9089 and accompanying instructions, such a person�s name and/or contact information, e.g., the phone number and email address, must be different from the attorney or agent name and/or contact information listed in Section E of the ETA Form 9089, unless the attorney or agent is an employee of the employer. I have 2 H1B Transfer questions for clarification.
1. Can H1B Transfer be filed when H1B Extension is pending with the current employer?
Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.
2. Do i need to have copy of I-140 approval notice for H1B Tranfer? The current employer does not share this document.

Hi all,
Need your advise. I have an approved PERM Labor (2006)
Also filed for I-485 in July 2007, got EAD, AP.
Lately i noticed that my Date Of Birth is incorrect in page 5 of ETA 9089 Labor Form. This error is in section J Alien Information.

My employment based I-485 application has been pending since Aug'2004. My labor priority date is May 2003. I came to know from immigration officer from local office few weeks ago that name check process was cleared very recently. But, USCIS has responded to a recent service request as follows:
The processing of your case has been delayed. We are currently awaiting the results of required security checks on this case. These background checks are required of all who apply for the immigration benefit your are seeking. We will make every effort to make a decision on this case as soon as security checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact us by calling our customer service number provided down below.
If name check is cleared what else is pending? Is information provided by the immigration officer at local USCIS is wrong regarding the security checks.
Could you please throw some light on these background checks. What are my options. How many more years do i have to wait? Your valuable information in this regard is greatly appreciated.

I am applying for MBA program in american sentinel university.
I want to know if I am eligible to apply for H1B in master's quota after I graduate from this univ. American sentinel university has Institutional Accreditation by the Distance Education and Training Council (DETC). Please help me in this regards.
Today I called USCIS and they said that they cannot tell anything and only service centers take decision on the case.

some body told me that if you are on H1B1 then you can not file for greencard. is it true?

It will be subjective of the examining officer...he could choose to deny the 140, issue an RFE or may even just ignore it...
I understand is a grey area but i was wondering if anybody here had some issues like that. Hopefuly, whatever he does is not going to be denying it...

i did not receive any correspondence for my I140 as well as for my labor.
My company provided me with a copy of my approved I140 (scanned) but refused to share any info on the approved labor.

Well there are plenty of Credit Unions who offer better rates if you do a little dance for them. They offer high interest checking accounts if you do x number of debit transaction and 1 ACH (direct deposit) etc. I have accounts with 2 such CUs (ADvantis & Oregon Community CU) which give me 3.0 & 2.9% respectively.
I'd rather use those debit cards that give me a good interest rate on my SAVINGS than credit cards (like chase) who give me 2-3% on my SPENDING.

Since H-1 B is an employers petition, It will be delivered to the employers place of business, unless you used an attorney in which case the attorney will have it.
If the notice is lost in the email, you have to request a duplicate notice before you apply for visa at the consulate
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Approval notice sent.
On June 22, 2007, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.
I have received mail from uscis for my H1B visa status.
What to do know.?
Will I receive mail in INDIA or my company who has filled H1B Visa will receive it ?
Today is 03 July 2007 still i have not received any courier from USCIS people.
Please help me what to do next.????
