This was expected. Tancredo was a single issue candidate and most people of this good country are sensible. They see him for what he is. Economic hardships combined with lots of false information can easily bias even the most well meaning citizen.
He did manage to bring illegal immigration topic to prominence and promoted general hatred towards immigrants. Personally I am happy he is out and I hope this country will be spared from any further "public service" from this abominable politician.

If you are impacted by unavailability of visa number, you can get 3 year extension of H1B after I-140 is approved. If your priority date is current, then you have to file for status adjustment, not H1B extension. If your lawyer does not understand the law, better get a "real" lawyer :)
I just got my Labor approved a couple week ago and now i want to file I-140 premium processing. But my lawyer's not allow me to do that coz once my I-140 approve i can't file my 8 th year extension. My 7th years H1B will expire on Aug 30, 2007.
I'm very confused now, on my understanding once i get my I-140 approve, i'm eligible to get my H1B 3 years extension.
FYI: i chose CP opotion, is that make me not eligible to get my H1B extension once my I-140 approve?

Pending EB2 cases for china are around 2000 as per USCIS inventory .
but as per DOS Demand data its only 500 ..

thats very sad and bad on part of the HR. should always use fedEX, UPS for tracking such imp docs. anyways you can use Form I-824 Application for Duplicate Approval Notice.

How difficult would it be to work with the USCIS dept to "allow" filing of I-485 stage on a continuous basis when priority dates are not current? In the current scenario they are pre-adjudicating cases up to July 2007 and are allocating visa's number to them as and when DOS makes them available. They can might as well allow a continuous filing of 1-485, pre-adjudicate them, and then we can wait when DOS gives the visa numbers to get the GC. On the USCIS side of things they will at least reduce their deficit, from fees for i-485, EAD, AP, Renewals. On our side we get the EAD which eliminates employer dependency, visa stamping, visa renewal, proving employer-employee headache. This may sound like a baby step to streamline the GC process. Will this need any type of legislative effort? Is this possible?

I had filed my I485 directly at TSC , the address which was listed on my I140 Receipt on June 25th as per the advise given by IO when i called the 800#

Following is the situation:
My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).
Falling short of 10 weeks to get the 365 days rule
Options that I learnt for me getting 7th yr extension and staying in the country:
Option1:
Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Convert from H4 to H1 and start working.
Option 2:
Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Stamping in canada to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 3:
Go back to India for 3 months wait till June 20th,
File for 7th year extension based on the 365 days rule
Stamping in India to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 4:
Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

I selected H1B: SPECIALITY OCCUPATION as that was the manner i last entered the country in Dec 2007. Even though i have an AP(haven't used it) but for my wife(who entered on AP) i selected DA: Advance parole. So if you used AP at POE then your status is DA. Hope that helps :)
