I'm a July 2007 filer going to file for my EAD for the first time. Since I'm currently on H1B, how should I answer this question
I'm applying for:
a) Permission to accept employment
b) Replacement
c) Renewal of my permission to accept employment
I think I need to go with option "c" since moving from H1B to EAD would qualify for a "c" response
Please advise.....

If you are born in UK and if you apply for labor certification under EB-2 category (job requirement: Master's degree or BS+5 yrs exp) then your priority dates are current and you can file for I-485 and get your GC in about 1.5 yrs...(ofcourse only if its not stuck under name check or any other complications...)

Ajju, Mine & wife's applications for 485/EAD/AP reached Nebraska on 07/25/07 and I have receipt dates of 08/27/07. I'm yet to receive it from my lawyer. Found out the LIN #'s from the back of my encashed check. No finger print notice yet. I do not think every one who filed between 07/17/07 to 08/17/07 will have a receipt date of 07/17/07

We filed 485 on Jul 2nd. So far no receipt yet.:(
My wife's F1 status is going to expire in Aug. She needs to change her status to H4 now. Will the status change have any negative influence on our 485 application? Do we need to send some amendment regarding the COS?

Looks like 245(i) cases can be filed in any employment category. Most cases were filed in EB3 and very few in EB2. This is because EB3 category accommodates people with no education and with minimal experience via (i) (ii) and (iii) categories with in EB3.
It seems logical that EB3 was near current until 2005 as all the 245(i) cases were rotting in BEC centers. As BECs started clearing them EB3 got hit. Unfortunately none of us predicted this. There is no efficient way to separate them at 485 stage as they fall under various categories.

YES! EAD is your license to work for any company, even for those not sponsoring you. It doesn't matter if your i140 is approved or not, you can work with EAD and that is legal.

In 2005 I (american citizen) applied for a I-130 petition for my husband who is an Indian citizen. (It was approved.) Then after that the case was placed under administrative review at the Mumbai embassy in India. It is still pending for over four years now. As of Sept. 2008 My husband recieved a letter stating the petition was sent to the USCIS here for review and possible revocation. We were told to contact them here for our case. They can not find anything on our case.
He is now in Canada on a student visa. Can I apply for a K-3 visa while he is in canada on a student visa? I was told he would need to go back to India for me to apply for a K-3 visa. USCIS agent told me to take the steps in applying for a K-3 visa for him.

My Labor is stuck in Atlanta processing center.... It is frustrating to see people getting approvals in 2 days from Chicago center.
While people who apply to Chicago today, can file 485 by July, I'm gonna miss the boat :eek:

The new facility replaces the former Manchester location on Canal Street. The new office is based on a national model for new USCIS office locations throughout the country.

Many threads here are on this, you've got to look for it and read. You've asked a question that has been asked and answered many times. That is why nobody has answered your questions.
In brief, you can use AP to come back, and work with H1B for the company who filed your H1B petition, and you can extend or transfer your H1B as well. You can also work on EAD for anyone you want, but you cannot come back to H1B.
There is more on other threads that will make you feel more positive about these answers, and helpful info on traval with AP.

My case was filed in EB-3 category (August 2003). I completed a doctorate in 2007. I am thinking of filing in EB-1 and EB-2. Can anyone help me with links for preparing these applications and some dos and donts? Also is there any way to recapture my earlier PD (Aug 2003) for the current filing? Thanks for your help.

Do we get a notice to get biometrics done when you apply for EAD renewal?
My wife and I have a EAD renewal RD of June 23, 2008 at NSC. We have not gotten any LUD after that. Anybody knows how long it takes to get the EAD?

I need help. I had filed 2 I-485 applications. I was thinking that my first application would be rejected due to the incorrect filing fee that I sent but they accepted and I already have a receipt number and fingerprinting appointment next week. The 1st receipt # was issued from the TX Service Center. Today I got the 2nd receipt # from Nebraska. I don't know what I should do? Should I contact the USCIS and withdraw the one in Nebraska. The problem was that I sent two applications because I thought they were going to reject my first one because I sent a $1010 check instead of the $395. Now they both cashed my checks. I doesn't really matter to me but my concern now is since I already have a fingerprinting appointment next week. What should I do? Will they reject both of my applications?
