Can't avoid anything that future hold for you.
1. It would be good if the employer does not let USCIS know about your layoff.
2. don't apply for unemployment benifits even if you are given one (at least for 180 days from I-140 approval).
3. Hoping your employer does not revoke your I-140
4. Take a 3 months unpaid vacation at the same job and/or offer help by working from home. Accept a lower salary for 180 days.

I am working for a Company A and I have a Labor and I 140 approved for OCT 2005 EB2 through the same company.
I filed my I 485 on July 2nd. Now I have a very good offer from Company B. I have following questions and I seek your help -
1) Can I retain my PD?
2) If yes, what are the requirements and what is the process to retain the old PD?
3) Does the Company B have to file I 140 again?
4) What if Company A pulls back their I 140? Can they?
5) What are the risks?
6) Has anyone done this and had a success?

In the application filed, I received a query stating "Labor Condition Application is marked to indicate you are an exempt HIB dependent for the beneficiary based on the existence of masters degree from the United States. Please confirm your claim that you are an expemt for this beneficiary. If no United States masters degree exists for this beneficiary, the LCA is not valid and may require a withdrawal of the current petition and filing of a new petition with a new LCA that adhers to Labor Department's requirement for H1B dependents".
My Employer wants to reply that this was a clerical mistake..... Is this right? or should he file a new petition.

It is not just enough for you to have the qualifications for EB2. The job requirements also should have that requirements. So in the PERM application - the job requirements has to be specified. I think the lawyer messed up the PERM process

Just be honest. For now you can say "No" as it is not full time. If VO asks more question on it tell them "you were not sure and ask them what it needs to be since she is doing part time. Take relavent docuemnts to show she is a part time.
All it needs to get visa is Honesty.

Hello Gurus,
My 6 years H1B visa term is expiring on Apr 30th 2008. My company filed 3 years of extension on approved I140 basis, which is still pending as of Apr 30th 2008. And my I 94 is dated till Apr 30th 2008.
I filed my I 485 in June 2007 and got EAD and AP
1) What will be my status after Apr 30 2008. Will I still be on H1 status, if not what will be my status.
And what is 'H1 pending for 240 days rule'.

Got a 1-797 Notice of Action today in Mail for my pending I-485 and the Notice Type: WELCOME NOTICE: SECTION: Adjustment as direct beneficiary of immigrant petition.
In the details section it says" Welcome to United States"...your application for permanent residence has been approved...we will soon mail you a new Permananet Resident Card....
HOWEVER, the online status still shows "Case pending" and NO LUD update.
1. Any reason to get concerned as the online case status still show it as Pending altough I see approval in Mail Notice?
2. Should i call customer service?
3. How long typically the card in mail takes?

Since you are in H1B the employer would book your ticket to US and secondly, if in any case if you have to go back the employer would give you a return ticket back. That's what most of the employers do.
After reaching US, be active in IV forums as well as join the state chapter.

My travel agent told me that since I have a multiple entry visa (expiring on Oct 2011) a return ticket is not required unless I need to travel back home within one year. Could someone with knowledge about this issue help me out. I would really appreciate a reply from someone who recently landed in the US on H1B.

Wife and I applied for our 485 on june 16th 2007 and we got our receipt numbers and did our biometrics on August 1st. As of yesterday I got my EAD card. My wife has not. Is that common or is this something I need to be worried about. If anyone has any knowledge, please let me know. I checked USCIS where i have an online account and have registered all the receipt numbers, for her it says it's still pending.

This is not really a revelation as visa fraud has been a problem for decades at US consulates around the world. But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.

Is there any way we can check our labor processing status as it is a genral fact that no employer would prefer to give his employee to access his status and at the same time they would not let employee to call attorney directly.So in this kind of scenario I was just wondering is there anyway we can track the status.

Unfortunately the answer is No.
You will have to wait (and trust) for your employer/attorney to give you this info.
Also you can check on the current perm processing dates which the USCIS issues I think every 3 months to see
how far the queue has moved and if you know approx date when your labor was filed you can make a guess
based on the published date and your filing date

I guess it means nothing to us. My file has moved over the years from CA -> NE -> SJ NBC -> TSC.
TSC was the most efficient machinery USCIS had. Someone in NSC may not have liked this, so they are moving the old files to TSC to make it look just as bad. :D

I had applied for my H1B extn and got an RFE. Lawyers replied to it and its almost 7 weeks now, haven't got any reply.

PL 111-230 requires the submission of an additional fee of $2,000 for certain H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) and $2,250 for certain L-1A (http://www.h1b.biz/lawyer-attorney-1137416.html) and L-1B petitions postmarked on or after August 14, 2010. Petitioners subject to this new fee include employers with more than 50 employees in the U.S., for which 50% of their workforce is on H and L visas. The fee will remain in effect through September 30, 2014.
USCIS indicated that Vermont Service Center and California Service Center were instructed to hold any H or L petitions sent after that date, pending guidance on how to determine whether the petitioner is subject to the new fee. USCIS will be modifying the I-129 or H-1B Data Collection Form to include information on whether this fee applies.
In the interim, USCIS suggested that petitioners could proactively include a �certification� regarding the fee, including a notation of whether the fee is required in bold capital letters at the top of the cover letter. The sample certification that the petitioner is not obligated to pay the fee would be:
