I am a labour substitution case pd feb 2002 filed 140 in June at NSC. My 140 has been pending for more than a year. Now recently I received 2 year ead.
Does this imply my 140 is approved too???
Is it safe to work on ead of one gets 2 year ead with pending 140.??
please advice.
I do not understand why they grant EADs when your I-140 is not approved. The reason I bring this up is if a person loses his/her job and your I-140 is revoked, the EAD is useless. You cannot use AC21 for that because your I-140 is not approved.
Nebraska center is doing nothing regarding I-140 EB-3 (India) apps. The I-140 date at Nebraska has beeing moving by 1 day per month for the last 7-8 months. It is stuck at March 30th 2007. Moreover, the latest "as of" i.e. "report" date that you see on Nebraska is July 31st 2008. It is not current (Sept 2008) as many of you may think.

Why don't they re-institute expedited I-140 approval?

Hi,
Wanted to know if there is any limitation on H4B visa date for coming in to US. My wife's H4B visa ends on Sep28 2009, she will travel and will be back on 28th Aug 2009. Is there any problem since its only 1 month from expiry.
In the meantime I will apply for an H1b extension.

I am getting a new job offer and i applied my GC this July just like most of us here. Is it possible to accept the offer and transfer the H1B visa, then try and negotiate to start later as soon as 180 days are completed?
What happens if i transfer my H1 now ... less than 180 days..and do not start with the new company, will my 485 still be processed? Lets say the H1 is transferred, but i plan not to use that H1 and stick to the same company where my H1 is, will that still be ok?
I am confused, its a good offer, and i dont know what to do. pls help..
An H1 transfer is not really a transfer. Just that you'll get another employer who is willing to and who can legally hire you. It does not mean you HAVE TO work for the new employer.
All the options you discussed here are safe for you.
1) Get H1 'transferred' now and join the new employer after 6 months are over
2) Get H1 'transferred' now and don't join the new employer.
Just make sure your new job description is similar to your LC job description and it has been 180 days since you filed your I-485.. Chill

I received I485 receipts from my lawyer, they are missing my priority date which is in sept 2002. Not sure why they are missing..
Did any one come across the same situation....

Usually Receipt notices will not have PD's only the approval notice's will have the PD's. Check you 140 Receipt/Approval notice as well. Its OK.

My husband is in the same position too.He is a fellow and got a job to start in 2008 july.lc dne.i 140 pending..
Can he file for i 485....ead for a future job...this has been in our head since this evening....cant wait till tomorrow morning to ask the lawyer:rolleyes:

given the priority date and the processing dates i want to understand how the uscis will process our applications
now the Nebraska service center is processing June 8, 2008. so based on the priority date it is processing all the applications that are current and have been filed before June 8th. Now let us say they take an application and start processing it and suddenly the PD goes back and I am not current any more - what do USCIS do. Do they just stack it back or what do they do. any thoughts.
