I am with company A on L1B in the US. Company B is processing my GC for future employment. Now my L1B is up for renewal in December. There is a lot of paperwork that my company has asked me work on. In one of the questionnaires, I am asked if my labor / 140 / 485 is pending. I don't know what to answer.
-- The truth.
Does any of the forms for L1B renewal needs this info? Will it be an issue if I say no? Does USCIS really care?
-- if you lie and USCIS finds out then you are in big trouble. Also, existing applications can be looked up at any time (Eg: while adjudicating your 485 they can go over your old L1 application).
Atleast the visa stamping form DS-156 asks if an immigrant visa petition has ever been filed for you, so its not uncommon, dont know about L1.
Pls share your experiences.

The substitute elimination rule is still under review and not in effect yet. The premium processing can be done with substitute labor, by attaching the original labor certification.

Planning to apply for GC.....I don't know about PERM processing...
1, How long its taking for PERM processing (including ad etc.,)?
2. Which center is doing PERM faster?
3. will there be any issue if 2 companies file for LC for me in the same center? my current employer is going file LC, but thinking to join some other company.
Please help.
1. To file the PERM itself it is minimum 60 days, though realistically it would be closer to 75-90 days to file. Regarding processing time, it depends on which category, if it is subject to audit, etc. I would say average would be 4-5 months.
2. Chicago hands-down is definitely faster than Atlanta.

Hi Folks,
I am currently on EAD and am applying for extension using e-file. I had a question on what do we fill in for 'Current Immigration Status'. The closest I can think about (as per the options given) is : DA - Advance Parole (Dist Auth).
Any comments?

I also have the same status. I think it has to do with finger printing when had filed for 485 during July 2007. My status is like that since Dec 2007 .Nothing has changed after that for me..
